A virtually unknown law was key to attorneys obtaining a multimillion-dollar settlement for the estate of Sophia Gutierrez, a seven-year-old who was hit by a
vehicle when she was leaving her elementary school.
“This was the first known case to successfully use the Ramon Turnquest School Crossing Guard Act since
it was passed in 1992,” their attorney said.
“The act requires the Florida Department of Transportation to adopt uniform guidelines and the training of school
crossing guards.”
In January 2022 as she attempted to cross a busy intersection, Gutierrez was struck. Defendants, Kemp Group International Corp., were
supposed to have three crossing guards positioned, However, there were only two crossing guards and they improperly allowed Gutierrez, her sister, and her parents to pass through the intersection. At the time, a Hyundai Tucson was being driven erratically and off the road while approaching the intersection, court records show.
