What types of criminal records are eligible for Expungement?

- No Action - following an arrest, no action was taken, there was no indictment and no presence of charging documents.
- Acquittal - a judge or jury ruled not guilty which consequently dismissed the case.
Most nonviolent crimes can be expunged more often, particularly in juvenile cases.
What are the
requirements for Expungement?
- After 10 years of being sealed, an ineligible record for expunction may become eligible.
- Charges that led to not guilty verdicts can only be expunged 10 years after being sealed
- In a single proceeding, only one arrest record can be deleted
- If the arrests are related, more than one record may be sealed or expunged in the same proceeding.
- People seeking expunction must attest that they have never had a
sealed record expunged previously.
